Special Election - May 19, 2020

On December 17, 2019, the Fountain Hills Town Council adopted Resolution 2019-59, calling for a Special Election to be held on May 19, 2020, to refer to the voters:

Ordinance 19-03        Rezoning 59.79 acres generally located at the northeast corner                                                        of Shea and Palisades Boulevards from L-3 P.U.D. and  OSR 
                                    to Daybreak PAD  

Resolution 2019-39    Changing roughly 23 acres near the northeast corner of Shea                                                          and Palisades Boulevards from Lodging to Multi-Family/Medium

Also that evening, the Fountain Hills Town Council adopted:

Ordinance 19-19         Amending the Town Code Chapter 2 by amending Section
                                    2-1-1, Elected Officers, dealing with the term of the office of
                                    Mayor and providing for a vote of the qualified electors of the
                                    Town approving said change

Below is the wording for each of these questions as they will be on the official ballot. Question numbers have not yet been assigned by Maricopa County. As soon as they are, this page will be updated.

PROPOSITION NO. 427

Official Title:         Ordinance Amending Zoning for Daybreak

Descriptive Title:  A referendum ordered by petition of the people, of Ordinance 19-03 amending the Fountain Hills Official Zoning District Map for approximately 59.79 acres generally located at the northeast corner of Palisades Boulevard and Shea Boulevard from L-3 P.U.D. and OSR to Daybreak PAD.

A “YES” vote shall have the effect of approving Ordinance 19-03, thereby amending the Fountain Hills Official Zoning District Map for approximately 59.79 acres generally located at the northeast corner of Palisades Boulevard and Shea Boulevard from L-3 P.U.D. and OSR to Daybreak PAD.

A “NO” vote shall have the effect of not approving Ordinance 19-03, thereby maintaining the zoning of said property at L-3 P.U.D. and OSR.

PROPOSITION NO. 428

Official Title:         Resolution Amending General Plan Land Use Map for Daybreak

Descriptive Title: A referendum ordered by petition of the people, of Resolution 2019-39 amending the Fountain Hills General Plan 2010 Land Use Plan Map from Lodging to Multi-Family/Medium for property located on the east side of North Palisades Boulevard, north of Shea Boulevard.

A “YES” vote shall have the effect of approving Resolution 2019-39, thereby amending the Fountain Hills General Plan 2010 Land Use Plan Map from Lodging to Multi-Family/Medium for property located on the east side of North Palisades Boulevard, north of Shea Boulevard.

A “NO” vote shall have the effect of not approving Resolution 2019-39, thereby maintaining the land use designation as Lodging.

PROPOSITION NO. 429

Official Title:         Changing the Term of Mayor from Two Years to Four Years

Descriptive Title: Referred to the people by the Town Council, Ordinance 19-19 amending Section 2-1-1, Elected Officers, of the Town Code changing the term of the office of Mayor from two years to four years.

A “YES” vote shall have the effect of approving Ordinance 19-19, thereby amending Section 2-1-1, Elected Officers, of the Town Code changing the term of the office of Mayor from two years to four years.

A “NO” vote shall have the effect of not approving Ordinance 19-19, thereby maintaining the two-year term.

INFORMATIONAL PAMPHLET - ARGUMENTS



Propositions will be presented to the qualified voters of the Town of Fountain Hills in an informational pamphlet. The pamphlet will be mailed to the households of all registered voters prior to the start of early voting.

Any person(s) wishing to submit a statement FOR or AGAINST the propositions may submit them for publication in the informational pamphlet. Each argument cannot exceed 300 words in length and must contain the sworn statement of each person sponsoring it. If the argument is sponsored by an organization, it shall contain the sworn statement of two executive officers of the organization, or if sponsored by a political committee, it shall contain the sworn statement of the committee’s chairman or treasurer. Each argument shall also be submitted to the Town Clerk in electronic format. A payment of one hundred dollars ($100.00), to offset a portion of the cost of paper and printing the pamphlet, must accompany the filing of each argument. The argument shall include the individual's address and phone number, which information will not appear in the pamphlet.

The following statement should be sworn to by each person signing the argument:

I declare under penalty of perjury that the foregoing information is true and correct and I am the sponsor of this argument advocating or opposing this measure, question or proposition.
